Terms of Service

1. Acceptance of Terms

By creating an account, accessing or using the Reflective AI service (referred to as “Reff”, “Reflective AI”, “the Service” or “the Application”), you agree to be bound by these Terms of Service (“Terms”). Please read them carefully before using the Service.

If you do not agree to these Terms, you must not access or use the Service.

These Terms constitute a legally binding agreement between you (“User”, “you” or “your”) and Gracjan Orzechowski, operating as the owner and operator of Reflective AI (“we”, “us” or “our”), with the Service accessible at https://getreflective.co.

If you are accessing the Service on behalf of a company or other legal entity, you represent that you have the authority to bind that entity to these Terms, in which case “you” and “your” will refer to that entity.

We reserve the right to update or modify these Terms at any time. We will notify you of material changes by posting the revised Terms on the website and, where appropriate, by sending a notification to the email address associated with your account. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

2. Description of the Service

Reff is a privacy-first AI thinking partner designed to facilitate structured reflection and strategic decision-making. The Service enables users to engage in guided, framework-driven thinking sessions with an AI entity named “Reff”, powered by the proprietary methodology.

Reff does not provide answers, directions or recommendations. It asks structured, context-aware questions to help you think more clearly, explore your assumptions and arrive at your own conclusions. All decisions remain entirely yours.

The Service includes, but is not limited to, the following features:

  • Structured AI-facilitated thinking and reflection sessions
  • User profiling to personalise sessions (goals, values, working styles, personality synthesis)
  • Session memory, enabling Reff to retain context across multiple sessions
  • Web and mobile application access

The Service is offered as a web application and a mobile application. Feature availability may vary by platform and by the access tier applicable to your account.

3. Eligibility and Account Registration

3.1 Eligibility

You must be at least 18 years of age to use the Service. The Service is intended for adults, including founders, entrepreneurs, leaders, managers, creators, hands-on practitioners and professionals engaged in high-stakes decision-making. The Service is not intended for use by minors.

By using the Service, you represent and warrant that:

  • you are at least 18 years old;
  • you have the legal capacity to enter into a binding agreement;
  • your use of the Service will comply with all applicable laws and regulations in your jurisdiction;
  • you are not located in a country subject to a government embargo or designated as a terrorist-supporting country by the applicable authorities;
  • you are not prohibited from receiving or using the Service under applicable law.

3.2 Account Registration

To access the Service, you must register for an account by providing accurate, complete and current information as requested during the onboarding process. You are responsible for maintaining the accuracy of your account information and for updating it as necessary.

You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us immediately at support@getreflective.co if you suspect any unauthorised access to or use of your account.

We reserve the right to refuse registration, suspend or terminate any account at our discretion, particularly where we have reason to believe that the information provided is inaccurate, false or in violation of these Terms.

3.3 Access by Invitation

During the Early Access phase, the Service is made available through invitation waves. Receipt of an invitation does not guarantee continued access and we reserve the right to manage capacity and access at our discretion to maintain a high-quality experience for all users.

4. Acceptable Use

4.1 Permitted Use

You may use the Service solely for lawful personal or professional purposes consistent with the intended functionality of Reff as described in these Terms.

4.2 Prohibited Use

You agree not to use the Service in any way that:

  • violates any applicable local, national or international law or regulation;
  • is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene or otherwise objectionable;
  • infringes upon the intellectual property rights, privacy rights or other rights of any third party;
  • involves uploading, transmitting or otherwise making available any material that contains viruses, malware, spyware or any other harmful or disruptive code;
  • attempts to gain unauthorised access to any part of the Service, its infrastructure or the accounts of other users;
  • involves reverse engineering, decompiling, disassembling or otherwise attempting to derive the source code, underlying algorithms or proprietary methodologies of the Service, including its proprietary methodology and associated AI agents;
  • attempts to manipulate, override or exploit the AI system through prompt injection, adversarial inputs, jailbreaking techniques or any other method intended to cause the AI to behave outside its intended parameters;
  • attempts to extract, replicate or reconstruct proprietary system prompts, agent instructions or underlying model configurations;
  • uses the Service to train, fine-tune, benchmark or develop competing AI models or products;
  • scrapes, crawls or uses automated means to access or collect data from the Service;
  • submits false, misleading or fabricated information during onboarding or in any session for the purpose of obtaining skewed outputs;
  • impersonates any person or entity or misrepresents your affiliation with any person or entity;
  • uses the Service in any way that could damage, disable, overburden or impair its performance or availability;
  • uploads or shares content that contains personal information of third parties without their consent;
  • uses the Service in any regulated context (medical, legal, financial, therapeutic) as a substitute for qualified professional advice or services.

We reserve the right to investigate and take appropriate action against any user who, in our sole discretion, violates any of the above, including suspending or terminating the user’s account and, where appropriate, reporting the conduct to relevant authorities.

5. User-Generated Content and Uploaded Materials

5.1 Scope

The Service allows you to input text, upload documents, audio recordings, video files and other materials (collectively, “User Content”) as part of your thinking sessions and use of the “Reflect on This” feature.

5.2 Your Responsibility for User Content

You are solely responsible for all User Content you submit to the Service. By submitting User Content, you represent and warrant that:

  • you own the User Content or have the necessary rights, licences, consents and permissions to use it and to grant us the rights described in these Terms;
  • the User Content does not violate the privacy rights, intellectual property rights or any other rights of any third party;
  • the User Content does not contain any material that is unlawful, harmful or prohibited under these Terms or applicable law;
  • where the User Content contains personal data of third parties, you have a lawful basis for processing that data and for sharing it with the Service.

5.3 Licence Grant

By submitting User Content to the Service, you grant us a limited, non-exclusive, royalty-free licence to access, process and use your User Content solely for the purpose of providing and improving the Service to you. This licence does not extend to using your User Content to train AI models. See Section 7 for our data and privacy commitments.

5.4 Sensitive Content

You should exercise careful judgement before uploading materials containing sensitive personal information - whether your own or that of third parties - including health information, financial data, legal documents or information about identifiable individuals. The Service is not designed as a secure repository for highly sensitive regulated data. You assume full responsibility for any risks arising from the submission of such content.

5.5 Content Screening

The Service operates an automated guard layer to screen uploaded files for security purposes. We do not use this screening to read, analyse or retain the substance of your materials beyond what is necessary to provide the Service. The existence of this guard layer does not constitute an endorsement or review of uploaded content.

6. Early Access and Paid Plans

6.1 Early Access Phase

The Service is currently operating in an Early Access phase. During this phase, access is provided free of charge to invited users, who receive a welcome credit balance to use within the Service. Early Access is offered as-is and without any service level guarantees. Features, limits and availability may change during this phase.

Participation in Early Access does not create any entitlement to continued free access, to specific features or to any particular level of service once the Service transitions to General Availability.

6.2 General Availability and Paid Plans

Upon the launch of General Availability, the Service will transition to a subscription-based model. Paid subscription plans, pricing, billing cycles (monthly or annual) and feature tiers will be communicated in advance of the transition. We will provide reasonable notice to existing Early Access users regarding any changes to access conditions.

6.3 Billing and Payment

When paid plans are introduced, the following terms will apply:

  • Subscription fees will be charged in advance for the applicable billing period.
  • Payments will be processed through a third-party payment provider. By providing your payment information, you authorise us to charge the applicable fees.
  • Unless cancelled prior to the end of the current billing period, subscriptions will automatically renew.
  • All fees are stated exclusive of any applicable taxes, including VAT, which will be added where required by law.
  • Fees are non-refundable except as required by applicable law or as expressly stated in these Terms.

6.4 Cancellation

Once subscription plans are available, you may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of the current billing period. You will retain access to the Service until the end of the paid period.

6.5 Price Changes

We reserve the right to change subscription fees. We will provide at least 30 days’ advance notice of any price changes. Your continued use of the Service after a price change takes effect constitutes your acceptance of the new pricing.

7. Privacy and Data

7.1 Privacy Policy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference and available at https://getreflective.co/privacy/. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

7.2 Data Commitments

We make the following commitments regarding your data:

  • We never train on your sessions. Your session data, User Content and thinking session transcripts are never used by us to train, fine-tune or otherwise improve any AI model. We contractually require that third-party AI providers we engage do not use your data for training purposes. Transient processing by AI providers during active sessions is an inherent constraint of the architecture and is described in Section 7.6.
  • Encrypted storage with client-side key derivation. Your data is stored encrypted using an architecture based on client-side key derivation. A compromise of our database infrastructure without an active user session yields no readable data - an attacker obtains only encrypted ciphertext. This is not cryptographic zero-knowledge: the server transiently holds your derived key during active requests in order to perform encryption and decryption operations. Your session content is processed in plaintext by the AI provider during sessions. See Sections 7.5 and 7.6 for full details.
  • GDPR compliance. We process personal data in accordance with the General Data Protection Regulation (EU) 2016/679 (“GDPR”) and applicable national data protection laws. Where required, we act as a data controller in respect of your personal data.
  • Data deletion on request. You have the right to request deletion of your personal data and session content at any time. We will fulfil verified deletion requests in accordance with applicable law.
  • User control. You retain control over your data and your thinking. The Service acts as a secure environment for your reflections - your thinking stays yours.

7.3 User Profiling

To personalise your experience, the Service constructs and maintains a user profile based on information you provide during onboarding and through your ongoing use of the Service (including goals, values, working styles and personality synthesis based on frameworks such as DISC and Gallup StrengthsFinder). This profiling is used exclusively to improve the quality and relevance of your sessions within the Service. It is not shared with third parties for commercial purposes.

7.4 Session Memory

The Service retains context across your sessions to enable continuity and personalisation of your thinking journey. You may request deletion of your session history at any time through your account settings or by contacting us.

7.5 Storage Modes

During onboarding, you select a storage mode. This choice is permanent - it cannot be changed after account creation. Choose carefully.

Standard Mode Your encryption keys are managed by the platform. This provides a more convenient experience and includes data recovery options. It requires placing trust in the platform’s key management practices.

Private Mode (default) Your encryption keys are derived from a passphrase that you set. The platform does not store your passphrase or your derived key between sessions. The practical consequences are:

  • A compromise of our database infrastructure, without an active session, yields no readable data.
  • There is no recovery mechanism. If you lose your passphrase, your session data cannot be recovered - by you, by us or by any third party. This data loss is permanent and irreversible.
  • You are solely responsible for securely storing and managing your passphrase.

Private mode is pre-selected during onboarding. Selecting Standard mode requires an explicit, informed choice.

Corporate Accounts Corporate accounts are assigned Private mode by default, with an additional organisational recovery mechanism available to designated administrators. Individual users under a corporate account cannot opt out of Private mode.

7.6 Third-Party AI Providers

The Service operates on a vendor-agnostic architecture and may use third-party large language model (LLM) providers to power the AI functionality.

As an inherent constraint of server-side AI processing, your session content - including your inputs and the questions generated by Reff - is transiently processed in plaintext by the AI provider during active sessions. This applies regardless of your chosen storage mode. This transient processing is necessary to generate responses and cannot be avoided without fundamentally changing how the AI functions.

We contractually require that AI providers do not use your session data for training, fine-tuning or improving their models. The specific providers in use may change over time; material changes will be reflected in the Privacy Policy.

8. AI Limitations and Disclaimers

8.1 Nature of the Service

Reff is an AI-facilitated thinking tool. It is designed to ask structured questions and facilitate reflection. It does not provide professional advice of any kind and nothing produced through the Service constitutes medical, psychological, therapeutic, legal, financial, tax, investment, coaching or any other form of professional advice or service.

8.2 Not a Substitute for Professional Support

The Service is explicitly not a substitute for:

  • medical or mental health diagnosis, treatment or therapy;
  • legal advice or legal services;
  • financial, tax or investment advice;
  • executive coaching or professional coaching services;
  • any other service requiring a licensed or qualified professional.

If you are experiencing a mental health crisis, emotional distress or an emergency, please contact the appropriate emergency services or a qualified mental health professional immediately.

8.3 AI Limitations

AI-generated outputs, including questions posed by Reff, are generated by probabilistic language models and may be:

  • inaccurate, incomplete or contextually inappropriate;
  • inconsistent across sessions;
  • reflective of biases present in underlying training data.

You are solely responsible for evaluating the outputs of the Service and for any decisions you make based on your reflection process. The Service is a tool to support your thinking - it does not and cannot make decisions for you.

8.4 No Warranties on Outcomes

We make no representation or warranty that use of the Service will result in any particular outcome, insight, decision quality, business result, personal development outcome or other benefit.

9. Intellectual Property

9.1 Our Intellectual Property

The Service, including its design, software, AI agents, the proprietary methodology, the “Reff” AI entity, all associated branding, text, graphics and functionality, is owned by Gracjan Orzechowski and is protected by applicable intellectual property laws, including copyright, trade secret and trademark law. All rights not expressly granted to you under these Terms are reserved.

You are granted a limited, non-exclusive, non-transferable, revocable licence to access and use the Service solely for your personal or internal professional use, in accordance with these Terms.

9.2 Restrictions

You may not:

  • copy, reproduce, distribute, republish or transmit any part of the Service without our prior written permission;
  • create derivative works based on the Service or its proprietary methodologies;
  • use the “Reff” or “Reflective AI” names, logos or trademarks without our prior written consent;
  • remove or alter any proprietary notices or labels on the Service.

9.3 Your Intellectual Property

You retain all intellectual property rights in the User Content you submit to the Service. Nothing in these Terms transfers ownership of your User Content to us. The limited licence granted to us in Section 5.3 is solely for the purpose of operating the Service.

9.4 Feedback

If you provide us with feedback, suggestions or ideas regarding the Service (“Feedback”), you grant us a non-exclusive, perpetual, irrevocable, royalty-free licence to use that Feedback for any purpose without any obligation to you. You represent that any Feedback you provide does not contain any confidential information of a third party.

10. Confidentiality of System Architecture

You acknowledge that the AI agents, system prompts, agent instructions, workflow configurations and underlying technical architecture of the Service constitute confidential and proprietary trade secrets. You agree not to attempt to access, extract, replicate or disclose any of this information and to take no action intended to circumvent the Service’s security or operational integrity.

11. Termination

11.1 Termination by You

You may close your account and stop using the Service at any time by contacting us at support@getreflective.co or through your account settings. Closure of your account will result in the deletion of your session data in accordance with our Privacy Policy and any applicable data retention obligations.

11.2 Termination by Us

We reserve the right to suspend or terminate your access to the Service, with or without notice, if:

  • you breach any provision of these Terms;
  • we reasonably suspect fraudulent, abusive or unlawful activity associated with your account;
  • we determine that your use of the Service poses a risk to the security, integrity or reputation of the Service or other users;
  • we cease to operate the Service.

11.3 Effect of Termination

Upon termination, your licence to use the Service will immediately cease. We will handle your personal data following termination in accordance with our Privacy Policy. Sections of these Terms that by their nature should survive termination - including intellectual property, disclaimers, limitation of liability and governing law - will continue to apply.

12. Limitation of Liability

12.1 Disclaimer of Warranties

The Service is provided “as is” and “as available”, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure or free of viruses or other harmful components or that any errors will be corrected.

12.2 Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Gracjan Orzechowski, operating as the owner and operator of Reflective AI, be liable for any:

  • indirect, incidental, special, consequential or punitive damages;
  • loss of profits, revenue, data, business, goodwill or anticipated savings;
  • damages arising from your reliance on any output produced by the Service;
  • damages resulting from unauthorised access to or alteration of your transmissions or data.

This limitation applies regardless of the theory of liability (contract, tort, negligence, strict liability or otherwise), even if we have been advised of the possibility of such damages.

Where liability cannot be excluded by law, our total aggregate liability to you for all claims arising out of or relating to these Terms or the Service shall not exceed the greater of: (a) the total amount paid by you for the Service in the twelve months preceding the event giving rise to the claim or (b) EUR 100.

12.3 Consumer Rights

Nothing in these Terms limits or excludes any rights you may have as a consumer under applicable mandatory law. If you are a consumer within the European Union or the United Kingdom, statutory rights that cannot be waived by contract are unaffected by these Terms.

13. Indemnification

To the extent permitted by applicable law, you agree to defend, indemnify and hold harmless Gracjan Orzechowski and any associated persons from and against any claims, liabilities, damages, losses and expenses (including reasonable legal fees) arising out of or related to:

  • your use of the Service in violation of these Terms;
  • your User Content, including any infringement of third-party intellectual property rights or privacy rights;
  • your violation of any applicable law or regulation.

The Service may contain links to third-party websites or services or may integrate with third-party platforms. These links and integrations are provided for convenience only. We do not endorse, control or take responsibility for the content, privacy practices or terms of any third-party service. Your use of third-party services is at your own risk and subject to the third party’s own terms.

15. Changes to the Service

We reserve the right to modify, suspend or discontinue the Service (or any part thereof) at any time, with or without notice. This includes changes to features, functionality, access models and available content. We will endeavour to provide reasonable advance notice of material changes where possible. We are not liable to you or any third party for any modification, suspension or discontinuation of the Service.

16. Governing Law and Dispute Resolution

16.1 Governing Law

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of the Republic of Poland, without regard to its conflict of law provisions.

Where mandatory consumer protection law in your country of residence provides greater protections than Polish law, those protections will apply to the extent required by law.

16.2 Jurisdiction

Subject to Section 16.3, you agree that the courts of Poland shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms or the Service.

16.3 EU Consumer Rights

If you are a consumer habitually resident in the European Union, you benefit from any mandatory provisions of the law of the country in which you are resident and nothing in these Terms affects your rights to bring claims before the courts of your country of residence.

You may also use the European Commission’s Online Dispute Resolution platform, accessible at https://ec.europa.eu/consumers/odr, to resolve disputes out of court.

17. General Provisions

17.1 Entire Agreement

These Terms, together with the Privacy Policy and any other policies or notices published on the Service, constitute the entire agreement between you and us with respect to the subject matter hereof and supersede all prior and contemporaneous agreements, understandings, negotiations and discussions, whether oral or written.

17.2 Severability

If any provision of these Terms is found to be invalid, illegal or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable or severed if modification is not possible and the remaining provisions shall continue in full force and effect.

17.3 Waiver

Our failure to enforce any right or provision of these Terms at any time does not constitute a waiver of that right or provision. Any waiver of a specific breach of these Terms shall not be deemed a waiver of any subsequent breach.

17.4 Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms without restriction, including in the context of a merger, acquisition or sale of assets.

17.5 Force Majeure

We will not be liable for any failure or delay in performance resulting from circumstances beyond our reasonable control, including natural disasters, war, civil unrest, government action, internet or telecommunications failures or power outages.

17.6 Language

These Terms are drafted in English. In the event of any conflict between the English version and any translated version, the English version shall prevail.
